Summary:
Despite the government’s rules, the National Medical Commission (NMC) is dismissing them citing lack of jurisdiction, giving complaints against doctors. This contradiction has expressed concern about patients reaching accountability and justice, which indicates a call for immediate explanation from the Ministry of Health.
A significant discrepancy has come to light between the Union Health Ministry and the National Medical Commission (NMC) to deal with complaints against doctors.
The ministry has said that the existing rules under NMC clearly empower the public to file a complaint against the medical doctors registered. These rules are meant to maintain accountability and ensure professional conduct in the medical community. However, in practice, the Commission is allegedly dismissing several complaints on procedural grounds, raising serious concerns about transparency and access to justice.
Officials of the Health Ministry claim that the Board of Ethics and Medical Registration (EMRB) under NMC is bound to consider and process legitimate complaints. A senior official said, “The rules are clear. There is no ambiguity about public rights to increase moral or professional concerns about doctors.”
In contrast, many complainants allege that NMC has removed cases citing technical or judicial boundaries. In some examples, complaints were reportedly not accepted.
NMC Turns Away Complaints Against Doctors
There has been a growing rift between the government and the National Medical Commission (NMC) to handle complaints against medical professionals. While the official government’s rules clearly state that patients, family members and the general public are allowed to file complaints about medical negligence or moral misconduct, NMC is allegedly rejecting such complaints.
Several cases have been reported in which the complainants have alleged that the NMC rejected their submissions, stating that only the State Medical Council or the Internal Institutional system is authorized for investigation. This has confused and criticized legal experts and health workers who questioned the transparency and accountability of the Commission.
The Union Health Ministry says that NMC is legally obliged to accept and process complaints under the National Medical Commission Act and related rules. However, insiders claim the NMC has adopted a limited role, focusing primarily on regulatory, educational, and licensing functions, rather than disciplinary actions.
